Data provided to Termignoni S.p.A.- with registered office in Predosa (AL), postal code 15077, via della Rampina, 1; registered at the Chamber of Commerce of Alessandria, REA 130295, Fiscal Code and VAT number 00862780061 (hereinafter “TERMIGNONI”) – through the website www.termignoni.it (“Site”) at the time of registration on the Site – or for the use of services from time to time offered by TERMIGNONI (hereinafter the “Services”) – will be handled with care, in respect of data protection laws and regulations; and in particular of Legislative Decree 196/2003 (“Italian Privacy Code”). Pursuant to article 13 of the Italian Privacy Code TERMIGNONI herein informs the user of what below.
The Data Controller of the processing of Personal Data is Termignoni S.p.A., with registered office in Predosa (AL), postal code 15077, via della Rampina 1; registered at the Chamber of Commerce of Alessandria, REA 130295, Fiscal Code and VAT number 00862780061, e-mail: email@example.com (“Data Controller”).
Scope of data processing and operational mode
- User’s Personal Data are gathered and processed exclusively for purposes directly related and instrumental to the activation and the functioning of the Services offered by TERMIGNONI, for the fulfillment of its legal obligations with users and to fulfill its obligations pursuant to applicable law, regulation or legislation.
- User’s Personal Data may, furthermore, be processed by the Data Controller for profiling purposes in order to collect data and information in general and in particular to collect data on the functions of the tool used and on geographic distribution in order to offer a more efficient and customized service.
- Lastly, e-mail and home addresses of the user – communicated during the registration to TERMIGNONI’s Site or during the activation of Services – may be used by TERMIGNONI for the promotion of commercial offers and services (similar to or connected to those which the user has subscribed); to send advertising material; or to carry out market surveys or commercial communication.
The user may oppose to such data processing – under 2 B) and 2 C) above – both by not clicking the relevant box during the registration to TERMIGNONI’s Site or during the activation of Services; and, later, by sending an e-mail addressed to firstname.lastname@example.org. Therefore, by clicking the relevant box during registration or activation of the Services the user gives his consent for the purpose herein above provided. Vice versa, if the user does not click the relevant box, it is understood that the user denies his consent for the purposes herein above provided.
Data processing and consent
Data processing at the time of registration on the Site or the activation of Services – for the purposes set forth in article 2A – is mandatory because strictly related to the execution of the Services. The refusal to provide personal data, in such cases, will result in TERMIGNONI not being able to complete the registration of the user and/or to provide the requested Services.
The denial by User – for the purposes described in articles 2B and/or 2C – will not affect registration to the Site, nor the obtainment of Services. The user in such circumstances will, in any case, have access to the Site and to the requested TERMIGNONI Services.
User’s personal data may be comunicated to specially designated personnel – appointed by TERMIGNONI – in order to carry out services that are instrumental or necessary to execute all obligations connected to: registration on our Site; possible online purchases; and, in general, to Services, based on and in compliance to the instructions received.
In particular, the User acknowledges that his/her personal data may be communicated – for the purposes described above – to:
- people, companies or professional firms, that provvide TERMIGNONI with services and/or counseling in relation to accounting, administrative, legal, tax and finance subject matters;
- third partyservice providers appointed by TERMIGNONI for which such disclosure isnecessaryfor the fulfillmentoftheir duties related to the activity or part of the activity of sale, as for customer care, even if outsourced; third parties appointed by TERMIGNONI who carry out after-sale services and every other external partner to whom the communication of data is necessary for the fulfillment of the Services;
- Public Administration forthe performanceof official dutieswithin the limitsestablishedby lawor regulation.
User data are not subject to disclosure and will not be circulated.
Data are collected electronically and processed through operations of recording, consultation, communication, storing, cancellation, mainly with the aid of electronic instruments; in respect of adequate security measures and confidentiality.
User data, stored on electronic instrumentation, are kept and filed on a server owned by TERMIGNONI. In particular, TERMIGNONI declares that the data stored on its servers are protected against the risk of intrusion and unauthorized access and to have, in addition, taken appropriate security measures to ensure the integrity and availability of the data as well as the protection of areas and locations relevant to storage and taccessibility of the data.
User data will be handled by specially designated associates, appointed by TERMIGNONI, as responsible or officer of the Data Controller (TERMIGNONI), in accordance to their respective functions and to the instructions received by TERMIGNONI.
TERMIGNONI guarantees the maximum level of security in handling user personal data. Credit card information is stored solely in incrypted format and according to PCI certification security requirements. TERMIGNONI does not have access to confidential credit card information that will be processed only by the respective intermediary and issuing credit/debit card companies, in accordance to the Italian Privacy Code. The User acknowledges that credit/debit card data will have to be provided in order to purchase Services. The data will be processed only by authorized financial institutions in compliance to the instructions of use and to the Italian Privacy Code applied by these same Institutions.
Pursuant to article 7 of the Italian Privacy Code the user has the right to obtain, in any moment, confirmation as to whether or not his/her personal data exists; and to know the purpose for which the data is processed. The user also has the right to ask to update, amend, cancel or block his/her personal data and to oppose to its processing in whole or in part.
The user may ask the Data Controller to exercise the rights hereinabove described and to receive information as to where the personal data is stored; to whom the data is communicated; or in which cases his/her data may be communicated by employees and/or officers authorized to do so.
Article 7 of the Italian privacy Code provides that:
A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
A data subject shall have the right to be informed of:
a) the source of the personal data;
b) the purposes and methods of the processing;
c) the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
A data subject shall have the right to obtain
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
A data subject shall have the right to object, in whole or in part,
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
The user shall send a request to the Data Controller email@example.com in order to exercise the rights herein described and to receive information on subject where his data are stored or to whom his data are communicated, or to the subject his data may be communicated in their quality of responsible or officer.
Data processing will last no more than the time necessary for the purposes for which the data were collected in compliance with the obligations of civil and tax regulations.
